What Casa Grande Gat's governing documents say
This is a commercial Declaration of Easements, Covenants, and Restrictions for the Casa Grande Gat development (Casa Grande, AZ), which governs a shopping center tract and several outparcels (separate parcels for commercial use). It is not a residential community. It establishes reciprocal easements, building design rules, use restrictions, parking minimums, and maintenance obligations among the commercial property owners. This document binds the owners of the commercial lots, not individual home or condo owners.
- Building & design restrictions: Buildings must not exceed 35 feet in height or have a metal exterior. No building may be constructed outside designated Building Areas. Outparcel buildings are capped at 8,000 square feet each. Rooftop equipment must be screened, and freestanding signs cannot exceed 15 feet in height. All utilities must be underground.
- Use restrictions: On the Shopping Center Tract, no theater, night club, bowling alley, billiard parlor, or business serving alcohol for on-premises consumption (unless less than 40% of gross sales) is allowed without Declarant's written consent. Similar restrictions apply to Outparcels, with additional prohibition on health spas, cafeterias, and amusement places without consent. Declarant may waive or modify these restrictions.
- Parking requirements: Outparcels must provide parking based on use: 15 spaces per 1,000 sq ft for restaurants/entertainment over 5,000 sq ft (and for McDonald's regardless of size); 8 spaces for restaurants/entertainment under 5,000 sq ft; 5 spaces per 1,000 sq ft for other uses. The Shopping Center Tract must provide at least 5 spaces per 1,000 sq ft of building area. Parking on one tract cannot count toward another tract's requirement.
- Access easements: A perpetual, non-exclusive Access Easement is granted over a shaded area shown on the Site Plan for pedestrian and vehicular ingress/egress to and from Florence Boulevard and Arizola Road. The easement area must maintain a 24-foot wide corridor for a driveway. Owners may not erect barriers that interfere with access, except one day per year to prevent public dedication.
- Maintenance & insurance: Each owner maintains improvements on their own tract, including exterior portions, landscaping, parking, and signage, in a first-class condition. Comprehensive public liability insurance with at least $5,000,000 per occurrence is required for Outparcels. All trash must be enclosed. No outside storage, sales, or advertising is permitted.
- Enforcement & liens: Violations can be enforced by suit for specific performance or injunction. If an owner fails to perform an obligation, an affected party may cure the default after 30 days' notice (or immediately in an emergency) and demand reimbursement with interest. Unpaid amounts become a lien on the defaulting owner's tract, recorded and foreclosable like a mortgage. The prevailing party in litigation is entitled to attorney's fees.
