This is a commercial Declaration of Covenants, Conditions and Restrictions for Casa Grande Mercado A, a mixed-use office, industrial, and retail development in Casa Grande, AZ. The rules bind the property owner (Grantee) and are enforced by the original developer or its successor. This document applies to business owners and investors, not residents.
- Permitted & prohibited uses: Allowed uses include office, industrial, and retail businesses such as stores, banks, restaurants, hotels, and gas stations. Prohibited uses include noxious or hazardous activities, truck stops, large vehicle repair shops, and certain chain restaurants (Denny's, IHOP, Bob Evans, Waffle House) until December 31, 2007.
- Building & design restrictions: All improvements require approval by the Grantor or Design Review Committee. Maximum building height is 30 feet. Setbacks, lot coverage, and exterior materials must comply with the more stringent of the Zoning Ordinance or Design Guidelines.
- Parking & loading: Off-street parking must meet Zoning Ordinance and Design Guidelines. Parking areas and drives may encroach on setbacks if screened. All parking areas must be paved and illuminated with screened fixtures. Loading areas must be paved and screened from view.
- Landscaping & maintenance: The property must be landscaped per approved plans with an underground irrigation system, completed within 60 days of a Certificate of Occupancy. The owner is responsible for maintaining all landscaped areas, including those within setbacks and easements.
- Signs: Signs are permitted only in compliance with the most restrictive of the Zoning Ordinance, Design Guidelines, or the Comprehensive Sign Program. Sign criteria may include size, number, location, shape, design, and color.
- Exterior maintenance & utilities: The owner must keep all improvements, landscaping, and irrigation systems in good repair. Utility connections (including electrical and telephone) must be underground to the extent possible, and meters cannot be exposed to view from adjacent property or streets.
- Enforcement & remedies: If the owner fails to comply, the Grantor may enter the property to correct deficiencies after 30 days' notice and impose a lien for costs, plus interest and attorney's fees. The Grantor may also seek injunctive relief or damages. Any institutional lender's mortgage takes priority over such liens.
