What Sandalwood Pha's governing documents say
This document is a State Housing Fund Program covenant between the Arizona Department of Housing and Pinal County (the owner). It applies to a rental housing project (Sandalwood Phase 2 and Parkview at Sierra Ranch) in Casa Grande, AZ. The covenant binds the owner, not the residents, to maintain 4 units as affordable housing for very low-income households for 15 years. Residents have certain rights and protections under this covenant, but this is not a full set of community rules.
- Affordability & income limits: Four units are designated 'State-assisted units' and must be rented to very low-income households whose annual incomes initially do not exceed 50% of the area median income (adjusted for family size). Tenants' incomes must be recertified annually.
- Rent restrictions: Rents for State-assisted units are capped at the lesser of the fair market rent (with utility allowance) or the Low HOME Rent (area 50% rent limit with utility allowance). Rents are subject to annual review and approval by the Arizona Department of Housing, and any increase requires at least 30 days' written notice.
- Lease terms & tenant protections: Leases must be for at least one year unless both parties agree otherwise. The lease cannot waive tenant rights (e.g., to sue, to a jury trial, or to notice before eviction). Termination is allowed only for serious lease violations, legal violations, or other good cause, with at least 30 days' written notice. Tenants must be selected from a written waiting list in chronological order, and rejected applicants must receive written notice of the grounds.
- Rental history & unit designation: The four State-assisted units are designated as 'fixed' (specific units permanently identified) for the 15-year affordability period. The owner may not convert them to other uses. If a tenant's income rises, the unit may switch to a High HOME Rent unit, but the next available unit must be rented to a very low-income tenant to maintain the count.
- Monitoring & recordkeeping: The Arizona Department of Housing may conduct on-site inspections and audits of the entire project. The owner must retain all tenant and financial records for five years after the agreement expires. The owner must also comply with affirmative marketing procedures to reach households least likely to apply.
