Adobe Towers is a single-family residential community in Chandler, AZ, governed by a homeowners' association (the 'Association'). Owners own their lot and dwelling unit; the Association maintains common areas. This Declaration of Covenants, Conditions, Restrictions and Easements sets out the binding rules for all owners.
- Assessments & fees: Annual assessments start at $35 per lot; the Board can increase them by up to 6% or the CPI percentage increase (whichever is greater) without member vote. Larger increases require approval of 67% of each membership class. Special assessments also require 67% approval. A separate road maintenance reserve account must be funded with at least $2 per lot per month after developer control ends.
- Architectural review: Any exterior changes (landscaping, paint, structures, etc.) require prior written approval from the Architectural Control Committee (ACC). Plans must be submitted; the ACC has 45 days to decide. Appeals to the Board are allowed after developer control ends.
- Leasing & rentals: Renting is allowed, but leases must be in writing and state that they are subject to the Declaration, Bylaws, and Association Rules. Owners are responsible for their tenants' compliance. No minimum lease term is specified.
- Pets: A reasonable number of generally recognized house pets are permitted, but they must not be a nuisance. Pets must be leashed when off the owner's lot, and waste must be promptly removed.
- Parking & vehicles: No overnight parking on streets. Vehicles must be kept in garages or designated areas. Trucks, trailers, boats, and similar vehicles are restricted: only automobiles, trucks, or vans not exceeding 7 feet in height and 18 feet in length, used for regular transportation, and without commercial signs, are allowed. Overnight street parking is prohibited.
- Use restrictions: Properties are for single-family residential use only. No nuisances, noxious activities, or businesses except home offices that do not generate traffic or deliveries. Outdoor storage and clotheslines are prohibited if visible from neighboring property. Basketball goals and play structures require prior architectural approval.
- Maintenance responsibilities: The Association maintains common areas including front yard landscaping, buildings on common area, roads, and utilities in common area. Owners maintain their dwelling units, lots, and landscaping within their walls; they must keep lawns mowed, trees trimmed, and remove dead plants. If an owner fails to maintain, the Association may perform the work and charge the owner, with a lien on the lot.
