What Superstition's governing documents say
This is a regulatory covenant (affordable housing covenant) that binds the owner of a rental housing project in Apache Junction, AZ, not the tenants. It requires the property to be used as rental housing exclusively for seriously mentally ill adults for a 15-year extended use period. The document is between the State of Arizona and the owner (Superstition Mountain Mental Health Center, Inc.) and does not contain typical HOA or condo rules.
- Use and occupancy restrictions: During the 15-year extended use period, the project must be used exclusively as rental housing for seriously mentally ill adults (as determined by a Regional Behavioral Health Authority). The owner cannot use the property for other purposes.
- Duration of restrictions: The covenants run with the land for 15 years starting from the date of recording (August 5, 2002). After the 15-year period expires, the restrictions terminate unless extended.
- Monitoring and recordkeeping: The owner must allow the State to inspect the property and must retain all tenant and project records for at least 5 years after the agreement ends. The State can audit records at any time.
- Enforcement and remedies: If the owner breaches any covenant, the State can demand transfer of title, seek a court order (injunction, specific performance, appointment of a receiver), or foreclose. The State is also entitled to attorney fees if it prevails.
- What this document doesn’t cover: This document does not address typical homeowner or tenant rules such as pets, parking, noise, architectural changes, or common area maintenance. It binds only the owner and does not govern tenant conduct or day-to-day living conditions.
