The Residences on Saguaro Condominiums is a rare 2-unit condominium in Fountain Hills, AZ — you own your individual unit's interior and an equal half-share of the building's common elements and grounds, maintained by the association and funded by equal assessments. Because there are only two units, the adjacent unit owner has significant approval rights over your structural changes and anything visible from their property.
- What you own & maintain: You own your unit's interior, fixtures, and half the common elements (exterior, grounds). You're responsible for maintaining and repairing your own unit at your own expense; you're also responsible for maintaining the limited common elements allocated to you (yard, patio, utility meters). If the association fails to maintain shared common elements, you must maintain those contiguous to your unit.
- Single-family residential use only: Your unit must be occupied exclusively for residential use by a single family (related by blood, marriage, legal adoption, or unrelated persons sharing a household). No business operations are allowed, though you may maintain a personal professional library, keep business records, and handle business calls or correspondence from your unit.
- Architectural review & restrictions: An Architectural Committee (at least 2 members) regulates external design and appearance. Solar devices, satellite dishes, and antennas cannot be visible from neighboring property without the adjacent unit owner's written consent. All utility lines must be in conduits or cables, underground or concealed. Non-structural interior alterations are allowed without approval; structural changes require the adjacent unit owner's prior written approval. No outside clotheslines.
- Party walls & adjacent unit owner approval: Your unit shares a party wall with the adjacent unit to a depth of half the wall's width. Any structural alterations to your unit require the adjacent unit owner's prior written approval. The adjacent unit owner must also approve anything visible from their property. You're liable to the adjacent unit owner for damage to their unit or the common elements caused by your negligence or willful conduct.
- Insurance requirements: You must maintain fire, casualty, and liability insurance on your unit at full replacement value with a carrier rated B+ or better. You and the adjacent unit owner must jointly maintain at least $500,000 in liability coverage; insurance costs are apportioned equally between the two units.
- Assessments & voting: Common expense assessments are levied equally on each unit (50-50 split with the adjacent unit owner). Each unit has one vote in the association, allocated equally. All major amendments require 100% approval from both unit owners, except where Arizona law permits otherwise.
- Board governance & declarant control: During the developer's initial "Period of Declarant Control" (90 days after all units are conveyed to non-developer owners), the developer appoints and removes board members. Once this period ends, unit owners elect a board of at least two members, both of whom must be unit owners. The board establishes an Architectural Committee of at least two members.
