It replaces Article V of the original CC&Rs, which covers insurance and casualty losses. The amendment does not address other rules like leasing, pets, or architectural standards.
- Insurance responsibilities: The association must carry hazard insurance on common-area improvements, general liability insurance, flood insurance (if in a FEMA flood zone), and fidelity bonds covering at least three months' general assessments. Each owner must obtain their own hazard, liability, and contents insurance for their lot and unit; the association is not liable for damage to owner property except for gross negligence or intentional misconduct.
- Casualty loss & repair: After damage to the common area, the board files claims, obtains repair estimates, and uses insurance proceeds to restore the area. Repair can be stopped only if at least 75% of members vote not to proceed within 60 days. If insurance proceeds are insufficient, the board may levy an equal assessment on all lots without a member vote. The association has no obligation to repair or reconstruct any owner's unit or lot improvements.
