What Lake Mirage Homeowners Association's governing documents say
Lake Mirage is a single-family home HOA in Gilbert, AZ (part of the master-planned 'The Islands' community). These CC&Rs apply to all lot owners and occupants. The association maintains common areas and enforces rules to protect property values.
- Residential use & business restrictions: All lots are limited to single-family residential use only. No business, professional, commercial, religious, or institutional activities are allowed, except for association activities.
- Pets: Up to one dog, cat, or other small household pet is allowed per lot without board approval; additional pets require board approval. No pets may be kept for commercial purposes, and pets causing unreasonable annoyance may be prohibited. Pets must not be left loose and must be walked only in areas designated by the board.
- Leasing & rentals: Leases must be in writing, for a minimum of 30 days, and must state that the lease is subject to the governing documents. A copy must be delivered to the association within 10 days of execution. The board may enforce lease defaults if the owner fails to do so.
- Parking & vehicles: On-street parking is prohibited on Lake Mirage Drive, Lake Mirage Court, and Mountain View Circle. Motor vehicles exceeding 3/4 ton, boats, trailers, campers, and similar vehicles must not be visible from other lots, common areas, or streets, with limited exceptions for small pickup trucks with camper shells and mini-motor homes meeting size limits. Inoperable vehicles may not be stored visibly. Garage doors must be kept closed except when in active use.
- Signs: No signs of any kind (including 'For Sale' or 'For Rent' signs) may be displayed on any lot or common area without prior written board approval under the architectural control article.
- Architectural control & exterior modifications: All exterior changes (construction, fences, walls, awnings, antennas, satellite dishes, lighting, screens, etc.) require prior written board approval. The board may regulate landscaping, color schemes, and other exterior appearance matters. Window coverings visible from outside must be white, off-white, beige, or natural wood-toned. No reflective materials or metal/plastic awnings are allowed unless originally installed by the declarant.
- Assessments: Annual assessments are levied uniformly per lot, plus special assessments for capital improvements (two-thirds vote of members required). Late payments bear 12% annual interest and may result in a lien on the property. The assessment lien is subordinate to first mortgages.
- Party walls & maintenance: Certain fences and walls on dividing lines are party walls; owners share repair costs. Owners maintain their own lots, units, and landscaping, except that the association maintains common areas. The association has a right to enter a lot for maintenance if the owner fails to keep it in satisfactory condition (after notice and opportunity to correct).
