Southern Enclave is a single-family home community in Phoenix, AZ, governed by a homeowners association (HOA). The rules apply to all owners, residents, and tenants. The community has gated access, and the HOA collects assessments to maintain common areas and enforce restrictions.
- Architectural review: Any exterior construction or modification requires prior written approval from the Design Review Committee, which can deny based on aesthetics alone. Interior changes are free if they don't affect exterior appearance. Applications must be decided within 45 days plus a 30-day demand period, or they are deemed approved.
- Use restrictions: Lots must be used for residential purposes only. Home businesses are allowed if invisible from outside and meet nine conditions. No nuisances, temporary residences, or outdoor clotheslines visible from neighboring property. No portable basketball goals; permanent ones require committee approval. No rooftop HVAC equipment.

- Vehicles & parking: No mobile homes, trailers, or commercial vehicles may be visible on lots or common area. Residents must park in garages if space allows, otherwise in driveways. Street parking for guests only, no overnight. No vehicle storage (covered) outside garage. No major repairs visible from neighboring property.
- Leasing & rentals: Owners may lease only the entire lot and residence for an initial term of at least 6 months. No subleasing. Owner must provide association with lease dates, tenant names, and emergency contact at least 10 days before lease start. Owner is liable for tenant violations.
- Assessments & liens: The association levies regular and special assessments per lot to cover common expenses. Nonpayment creates a lien on the lot. Owners must also pay a transfer fee and reserve contributions as determined by the board. Assessments are due as set by the board.
- Maintenance responsibilities: The association maintains common areas, including access gates, landscaping, and certain lot features if designated. Lot owners are responsible for their own residence, landscaping, and screening materials (fences, walls) in accordance with original design or approved changes. Improper maintenance is a violation.
- Dispute resolution: Disputes under the community documents must go through mediation first, then binding arbitration under the Federal Arbitration Act, unless otherwise agreed. The association can suspend common area use for owners more than 15 days delinquent or for unresolved violations.
