The Fairways at the Legacy is a master-planned residential community in Phoenix, Arizona where owners purchase individual lots and own their homes outright. This Master Declaration of Covenants, Conditions and Restrictions (CCR) establishes the legal framework for property ownership, architectural standards, use restrictions, assessments, and the powers of the homeowners association to manage common areas and enforce the community's rules—binding all current and future lot owners.
- What you own & maintain: You own your individual lot and the home built on it. The association maintains the common areas (Tracts A–G), streets, and walls bordering the golf course and common areas. You are responsible for maintaining the strip of land between your lot boundary and the back of the curb on private streets, and for routine maintenance (cleaning, painting) on the exterior side of any boundary wall facing your lot.
- Architectural Review & Approvals: Any exterior work visible from neighboring properties—including construction, landscaping, color changes, excavation, or grading—requires prior written approval from the Architectural Committee. The committee has 60 days to review; if it does not respond within 60 days, approval is automatically deemed granted. The committee evaluates workmanship, design harmony, aesthetic compatibility, and compliance with community rules.
- Residential Use Only: All lots must be used exclusively for residential purposes. Home-based business is permitted only if it is not apparent by sight, sound, or smell from outside the home; complies with local zoning; involves no frequent visitor traffic; and does not include door-to-door solicitation within the community.
