The Enclave at Gilbert is a master-planned commercial project in Gilbert, AZ, consisting of a senior living lot and five retail lots. This document is a Declaration of Easements and Covenants (a Reciprocal Easement Agreement) that governs shared improvements, maintenance, and cost-sharing among the commercial lot owners. It does not contain rules for individual homeowners or residents; it is a commercial property agreement.
- Shared improvements & maintenance: The Declarant (owner of the senior living lot) maintains shared improvements like access drives, signage, landscaping, and private sewer lines. All lot owners pay a share of expenses based on lot square footage.
- Easements: Each lot has non-exclusive easements for ingress/egress, wastewater connections, and drainage over designated areas. The Declarant also reserves easements to install and maintain shared improvements.
- Cost sharing & budgets: Declarant prepares annual budgets and invoices each lot for its share of shared expenses. Payments are due within 30 days; late payments bear 15% interest. A reserve account is maintained for replacements.
- Insurance requirements: Each lot owner must carry commercial general liability insurance ($2M per occurrence/$5M aggregate) and name other owners and Declarant as additional insureds. Large entities may self-insure.
- Default & enforcement: If a lot owner fails to pay or perform, the Declarant may cure the default and charge the owner, plus 15% interest and attorneys' fees. The Declarant has primary enforcement rights.
- What this document doesn't cover: This document does not contain homeowner rules (e.g., pet limits, leasing restrictions, age restrictions) or condominium bylaws. It is a commercial REA governing infrastructure and cost-sharing among lot owners.
