This is a partial amendment (Second Amendment) to the governing documents of 77 East Missouri Townhouses, a townhome community in Glendale, AZ. It does not contain the full set of rules; it only adds a single new requirement: a one-time Maintenance Reserve Fee due when a home is sold or transferred. The full Declaration and First Amendment contain the remaining rules.
- Transfer Fee (Maintenance Reserve): Upon any voluntary sale or transfer of a townhouse, the seller and buyer are jointly and severally liable for a Maintenance Reserve Fee equal to six months of the current annual assessment. The fee is nonrefundable, in addition to regular annual and special assessments, and may be used for reserves, expenses, or other board purposes. It is collected through escrow if the association is notified, but failure to notify does not eliminate the obligation.
- Exceptions to the Transfer Fee: No fee is due for transfers by inheritance (devise or intestate succession), for estate planning purposes, or to a corporation/partnership/entity in which the grantor owns a majority interest — unless the board determines the transfer was designed to avoid the fee, in which case it applies.
- What this document doesn't cover: This amendment does not address pet limits, leasing rules, age restrictions, parking, architectural review, or any other common HOA regulations. Those are found in the original Declaration (recorded 1972) and the First Amendment (1986), which are not included here.
