Bethany Point is a single-family home community in Glendale, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). These rules apply to all 119 lot owners and occupants, covering use restrictions, architectural control, and maintenance obligations.
- Leasing & rentals: Leases must be in writing, for at least 30 days, and cover the entire lot. No transient or hotel use is allowed. The lease must state that violation of the Declaration is a default under the lease.
- Occupancy limits & single-family use: Each lot is limited to single-family residential use, defined as one or more persons related by blood/marriage/adoption, or up to three unrelated persons, plus domestic servants.
- Architectural review: No exterior changes (structures, landscaping, paint, etc.) visible from other lots or streets may be made without prior written approval from the Architectural Committee. Plans are deemed approved if not acted on within 30 days after a meeting.
- Vehicles & parking: Vehicles may be parked only in the carport, garage, or driveway. No buses, vans, or trucks over 3/4 ton capacity, and no commercial vehicles are allowed except in screened areas. No in-view repairs.
- Pets: Only commonly accepted household pets are permitted, with no breeding allowed. Pets that create a nuisance must be removed.
- Signs: Only one 'For Sale' or 'For Rent' sign per lot, no larger than 4 square feet, placed in the front yard. All other signs require Architectural Committee approval.
- Party walls & shared structures: Walls or fences on lot boundaries are Party Structures. Adjoining owners share use and repair costs equally, unless damage is caused by one owner's act, in which case that owner bears the cost. Entry easements exist for repairs.
- Maintenance responsibilities: Lot owners are responsible for all maintenance, repair, and replacement of their lot and improvements, and must keep the front yard neat and compatible with the neighborhood.
