This is a Common Operation and Reciprocal Easement Agreement (CORE Agreement) for Northern Crossing, a commercial shopping center in Glendale, AZ. It governs the rights and obligations of parcel owners within the development, including shared easements, common area maintenance, and development standards. This document does not establish a residential community or homeowners association; it applies to commercial property owners and their tenants.
- Easements & Shared Access: The agreement grants and reserves easements over common areas for access, parking, utilities, drainage, signage, and construction. All owners and their permittees (tenants, customers) have rights to use common areas for ingress, egress, and parking, subject to restrictions on employee parking and reserved spaces.
- Common Area Maintenance & Assessments: Declarant (developer) is responsible for maintaining common areas (paving, landscaping, lighting, sweeping, etc.) and the cost is assessed against all parcel owners based on land area. Assessments are a continuing lien and must be paid within 30 days of statement; late payments accrue interest at the Default Rate (10% or 5% plus Fed discount rate) and may lead to lien foreclosure.
- Development & Architectural Control: All construction, exterior alterations, and signage require prior written approval from Developer. Plans must comply with Design Guidelines and be architecturally compatible. Buildings must be within Building Envelopes, and construction must be completed within 12 months. Retaining areas and trash facilities must be built as directed.
- Use Restrictions: Common areas cannot be used for merchandise sales, vending machines, carnivals, or political rallies without Declarant consent. No horn, whistle, or exterior sound devices (except music, security alarms, or drive-through speakers) are allowed. Graffiti must be removed within 72 hours of notice.
- Parking & Signage: Parking is for customers and tenants; employee parking must be on the owner's own parcel unless designated otherwise. Reserved parking requires Declarant consent. Pylon signs are shared and maintained by Declarant; sign panels require Developer approval. No overnight shopping cart storage except in approved corals.
- Enforcement & Default: If an owner fails to perform maintenance, construction, or pay assessments, Declarant may enter the parcel, perform the work, and charge the owner plus a 20% administrative fee. Delinquent assessments bear interest at the Default Rate and can be foreclosed as a lien. Disputes over assessments may be arbitrated.
