Sunburst Farms Nineteen is a single-family residential subdivision in Glendale, AZ. The rules bind all lot owners and are enforced by the Sunburst Farms (Glendale) Mutual Water and Agricultural Company, an association that primarily provides irrigation water and tillage service. This document sets lot-use restrictions, building standards, and governs property maintenance to preserve neighborhood value.
- Land use & building type: Lots are restricted to single-family residential use. Only one single-family dwelling, a private garage/carport, and a stable, livestock shelter, or tack room may be built. No secondary dwelling or separate residential building is allowed.
- Minimum house size: Any dwelling must have a ground floor area of at least 1,050 square feet, excluding open porches, pergolas, and attached garages.
- Setbacks & structure placement: Front walls must be at least 20 feet from the front property line (porch, garage, or carport may project up to 5 feet into that yard). Side walls must be at least 15 feet from each side property line. Stables/livestock shelters must be at least 25 feet from the main residence and 20 feet from any side property line.
- Fences & hedges: No solid fence or wall taller than 5 feet may be placed closer to the front street than the front building wall. On vacant lots, no solid fence over 3 feet high within 20 feet of the front line. Side/rear fences or walls may be up to 6 feet. Hedges within 20 feet of the front property line may not exceed 3 feet in height.
- Horses, poultry & livestock: Horses, poultry, and livestock are allowed for the owner's personal use (not commercial). Facilities must be kept clean and not a nuisance, and must be set back at least 70 feet from the front property line.
- Association membership & water service: Every lot owner automatically becomes a member of the Sunburst Farms (Glendale) Mutual Water and Agricultural Company. Membership is not transferable and entitles the owner to irrigation water and tillage service at rates set by the board. Unpaid charges become a lien on the lot, bearing 5% annual interest, and the association may enforce the lien (including power of sale) and collect attorney fees.
- Duration & amendment: These restrictions run with the land and remain effective until January 1, 1998, after which they automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. While the developer owns a majority, FHA and VA approval is required for amendments.
