This is a recorded covenant that makes every parcel in Barkley Hill a member of the Central Arizona Groundwater Replenishment District. It requires all property owners to pay an annual Replenishment Assessment based on groundwater use, and the assessment is a continuing lien on the property. This document does not contain typical HOA rules—it only addresses water-supply obligations.
- Water replenishment assessment: Every parcel is subject to an annual Replenishment Assessment levied by the Central Arizona Water Conservation District (CAWCD). The amount is based on the Parcel Replenishment Obligation, which depends on groundwater delivered to the parcel and the property's excess groundwater ratio.
- Lien for nonpayment: If the Replenishment Assessment is not paid, it becomes a continuing lien on the parcel. Interest, costs, and penalties as set by Arizona law (ARS § 48-3782) also apply, and each owner at the time the assessment was due is personally liable.
- Amendment and termination: This declaration can be amended or revoked only by the written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property. It can also be changed by amendments to applicable statutes or regulations.
- Binding on all owners: By accepting a deed or acquiring any interest in a parcel within the property, each owner is automatically bound by all covenants in this declaration. The covenants run with the land and bind all successors.
