What Villages at Gold Canyon's governing documents say
This is a temporary declaration for the Villages at Gold Canyon, a commercial office park in Gold Canyon, AZ. It creates covenants, conditions, restrictions, and reciprocal easements binding owners of individual office parcels. The document applies to commercial property owners and their tenants, not to residential homeowners.
- Permitted uses: All parcels must be used for lawful purposes consistent with first-class neighborhood office developments in Mesa, AZ. Prohibited uses include discotheques, pawn shops, adult businesses, massage parlors, flea markets, and on-premises food/alcohol consumption. Declarant may impose future additional use restrictions.
- Architectural review & construction: All buildings and improvements must be within designated Building Envelopes and approved by the Authorizing Agent (developer, then association). Preliminary plans are deemed approved if not objected to within 15 days. Construction must be completed within 18 months. Exterior alterations require prior written approval.
- Common Areas & maintenance: Common Areas include parking, landscaping, walkways, and roadways outside buildings. The Authorizing Agent maintains them at owners' cost. Assessments are based on each parcel's land area square footage. Owners must maintain their buildings and exclusive areas in a manner consistent with first-class office developments.
- Assessments & liens: Each owner must pay assessments for common area maintenance, reserves, and umbrella liability insurance. Assessments are a continuing lien on the parcel and personal obligation of the owner. Delinquent assessments accrue 12% annual interest and may be foreclosed. The lien is subordinate to prior recorded mortgages and property taxes.
- Insurance: Each owner must carry fire and extended coverage insurance (at least 80% replacement cost) and commercial general liability insurance with at least $2,000,000 combined single limit. The Authorizing Agent also maintains an umbrella policy. Owners waive subrogation rights among each other to the extent of insurance recovery.
- Parking & traffic: Parking is allowed only in striped spaces in Common Areas. No reserved parking (except handicapped) without Authorizing Agent approval. No permanent obstructions that impede vehicular or pedestrian circulation. Owners must not unreasonably interfere with business operations of others.
- Signs: All signs must comply with county regulations and receive Authorizing Agent approval on color, illumination, size, materials, and placement. No signs on roofs or in Common Areas without approval. Total sign area per parcel is separate and distinct from other parcels.
- Term & conversion: This declaration is temporary. It automatically terminates upon recording of a condominium plat and declaration for the entire development. Otherwise, it lasts 20 years from recording (June 2006) and auto-renews for 10-year periods unless terminated earlier by owners of 67% of land area.
