It does not contain the full HOA rules — it requires every property owner to participate in the Central Arizona Groundwater Replenishment District and pay annual assessments that become a lien if unpaid.
- Groundwater replenishment assessment: Each parcel (lot) is subject to an annual Replenishment Assessment levied by the Central Arizona Water Conservation District (CAWCD) based on the parcel's share of excess groundwater use. The amount is set by CAWCD to fund groundwater replenishment.
- Lien for nonpayment: If the assessment is not paid when due, it becomes a continuing lien on the property and a personal obligation of the owner at the time it came due. CAWCD may enforce collection with interest, costs, and penalties as provided by Arizona law.
- Automatic membership & binding effect: By accepting a deed to a parcel, every owner automatically agrees to pay the assessment and is bound by the declaration. The covenants run with the land and bind all current and future owners.
