What Superstition Vista's governing documents say
This is an ancillary restrictive covenant for Lot 43 of Superstition Vista (Gold Canyon, AZ). It binds the owner of Lot 43 to use the property exclusively as a well site and to share wall construction and maintenance obligations with a separate, larger 'Benefited Property' that will have its own HOA. This document does not set general HOA rules for the community.
- Exclusive use & purpose: Lot 43 must be used exclusively as a well site. No residential or other use is permitted.
- Shared walls & easements: The owner of the Benefited Property is responsible for constructing shared walls on Lot 43's boundaries. A nonexclusive easement allows entry onto Lot 43 for construction and maintenance. Each party maintains and repairs the side of the wall facing their own property.
- Limited architectural control: Declarant and the future HOA's architectural committee must approve plans for shared walls, screening of equipment, and landscaping on Lot 43. Approval cannot be unreasonably withheld.
- Enforcement & termination: The future HOA and Benefited Property owners can seek a court injunction to enforce these restrictions. The declaration terminates if Lot 43 is annexed into the Benefited Property's CC&Rs.
- What this document doesn't cover: This document does not address typical HOA matters such as assessments, pet limits, leasing restrictions, age restrictions, or amenity use. Those will be in the separate CC&Rs for the Benefited Property.
