Crismon Corner is a single-family home subdivision in Mesa, AZ. These Covenants, Conditions, and Restrictions (CC&Rs) govern all homeowners. They set rules for home construction, property use, assessments, and the homeowners association. This document applies to owners, tenants, and mortgage holders.
- Use restrictions: Lots are single-family residential only. No business uses, no multifamily dwellings, no hotels, hospitals, or boarding houses. Only one single-family residence per lot, plus accessory structures like garages and guest houses. Minimum livable area: 2,000 sq ft for one-story or split-level (grade+sub-grade), 1,700 sq ft for two-story at grade level.
- Leasing & rentals: Leases must be in writing, subject to the HOA rules, and have a minimum initial term of six months unless the Board agrees otherwise. Within 10 days of a lease or sale, the owner must provide the Association with the new occupant's name, address, and phone number.
- Architectural review: No building, fence, wall, or exterior alteration may be made without prior written approval by the Board or an architectural committee. Plans must show design, materials, and location; approval is deemed granted if not acted upon within 30 days. Specific construction requirements: masonry or stucco, tile or wood shake roofs, two-car garages, and minimum landscaping (three 5-gallon trees, ten 1-gallon shrubs, two 24-inch box trees, seeded or gravel yard).
- Assessments & fees: All lots are subject to annual and special assessments. Maximum annual assessment initially $50 per lot; can increase annually by the cost-of-living index (Valley National Bank index) without membership vote, or by a two-thirds vote of each class for larger increases. Special assessments for capital improvements require two-thirds vote. Unpaid assessments bear 12% interest and a $25 late fee, and create a lien on the property.
- Parking & vehicles: Private passenger cars and pickup trucks under 3/4 ton may be parked on side of lot, subject to setback and architectural approval. Campers, horse trailers, and boats must be screened and approved. No inoperable or under-repair vehicles allowed outside an enclosed garage. No commercial vehicles, except those stored in a garage.
- Pets & animals: Reasonable number of dogs, cats, birds, or fish may be kept as household pets if not a nuisance or threat, and must be fenced or otherwise controlled. Swine, peacocks, pigeons, and geese are prohibited. No animals bred or kept for commercial purposes.
- Common area & maintenance: Common areas (Tracts A and B, including drainage) are owned by the Association and maintained through assessments. Each owner has an easement to use common areas but may be suspended for unpaid assessments or rule infractions (max 60 days). Owners must keep their lots clean and free of weeds; the Association may clean after 10 days' notice and charge the owner.
