What Knoell East's governing documents say
This is a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for Knoell East Unit Seven, a subdivision in Mesa, AZ. The community consists of single-family and attached (common wall) homes, and the rules apply to all lot owners, tenants, and guests. The document sets use and appearance standards, pet and parking rules, and procedures for exterior changes.
- Residential use & home businesses: Lots may only be used for residential purposes (single-family homes, townhomes, patio homes). No gainful occupation or trade is allowed on any lot. Leasing of the entire lot is permitted, but no partial leases.
- Pets: Only a reasonable number of common house or yard pets (no farm animals) may be kept, and not for commercial purposes. Dogs and cats must be leashed (max 6 ft) when off the owner's lot and must not create a nuisance. Owners must clean up droppings. Pets cannot run at large.
- Vehicles & parking: No mobile homes, RVs, boats, trailers, or trucks over 3/4 ton may be parked on streets, sidewalks, front yards, or driveways unless fully enclosed by a fence or wall. Temporary construction vehicles are exempt.
- Signs: Only one 'for sale' or 'for rent' sign per lot is allowed, with a maximum face area of 432 square inches. All other signs (commercial, political, etc.) are prohibited.
- Exterior alterations & architectural control: No exterior changes (color, additions, alterations) may be made without prior written approval from Declarant (while Declarant owns lots). Applications must be submitted with plans; if not acted on within 60 days, approval is deemed granted.
- Common walls (attached homes): Owners of lots sharing a common wall have equal rights to use it. If damage is caused by one owner, that owner pays; if by other causes, adjoining owners share cost equally. Changes to a common wall require written consent of the adjoining owner.
- Leasing & tenant responsibility: Owners may lease their entire lot. Tenants are bound by all CC&Rs, and owners are responsible for their tenants', guests', and agents' compliance.
- Amendment & term: The CC&Rs run with the land for 20 years from recording (1983), then auto-renew for successive 10-year periods. Amendments require approval of owners of more than 50% of lots (Declarant must also approve while it owns any lots).
