Summer Place Terrace is a single-family home HOA community in Mesa, AZ. This Declaration of Covenants, Conditions, and Restrictions sets up the homeowners association, requires assessments for common-area and exterior maintenance, and imposes use restrictions on all lots. Each owner automatically becomes a member with voting rights and has an easement to use the common area.
- Membership & voting rights: Every lot owner is a member of the Summer Place Terrace Homeowners Association. There are two classes of membership: Class A (all owners except declarant) gets one vote per lot; Class B (declarant) gets three votes per lot and converts to Class A when total Class A votes equal Class B or by January 1, 1989.
- Assessments: Each lot must pay annual assessments for common-area and exterior maintenance, plus special assessments for capital improvements. The initial maximum annual assessment was $816 per lot; it can increase up to 5% per year without a vote, or more with a two-thirds vote of each class. Unpaid assessments become a lien on the property, accrue 10% annual interest, and may include a late fee up to 15% after 15 days.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. If destroyed by fire, any using owner may restore it, and other users must contribute. Disputes are settled by arbitration.
- Use restrictions: Lots are for single-family residential use only; leasing an entire lot to one family is allowed. Pets: reasonable number of domestic pets kept as such. No temporary buildings used as residences. No signs except one 12x18 inch 'For Sale' or 'For Rent' sign. Fences require prior approval. No clotheslines visible from adjoining lots or streets. Parking/storage of vehicles for repair is prohibited; washing/polishing is allowed.
- Architectural review: No building, fence, wall, or exterior alteration may be constructed without written approval of the Board or a designated architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed granted.
- Amendment & duration: The covenants run for 30 years from the recording date (1984), then automatically extend for successive 10-year periods. During the first 30 years, amendments require 90% of lot owners; after that, 75%. Any amendment must be recorded. While Class B membership exists, FHA/VA approval is needed for annexation, dedication of common area, or amendment.
