The Harbour At Val Vista Lakes is a single-family or townhome community in Mesa, AZ, governed by this 1986 Declaration of Covenants, Conditions and Restrictions (CC&Rs). It establishes a homeowners association (HOA) with a separate master association (Val Vista Lakes Community Association) that also imposes assessments and rules. The document applies to lot owners and residents, defining property use, maintenance obligations, and architectural standards.
- Residential use & single-family requirement: Lots must be used exclusively for single-family residential purposes. No business, profession, or trade is allowed on any lot.
- Assessments (HOA fees): The HOA levies annual assessments (initially capped at $1,188 per lot) and special assessments approved by two-thirds member vote. Annual assessments can increase up to 5% per year or by the CPI increase, whichever is greater, without a vote. Owners must also pay assessments to the master association. Temporary guest parking is allowed per association rules. Inoperable vehicles and repairs visible from streets or neighbors are prohibited.
- Signs: Only one residential identification sign (max 72 sq in), one 'for sale' or 'for rent' sign (max 5 sq ft), and signs required by legal proceedings are allowed on a lot.
- Architectural review: All exterior alterations, including color changes, additions, and new improvements, require prior written approval from the HOA's Architectural Committee (and the master association's committee). If the committee does not approve or disapprove within 60 days of a complete application, approval is deemed granted.
- Common walls & shared maintenance: For lots sharing common walls, owners have equal rights to use the wall. Damage caused by an owner must be repaired at that owner's expense; damage from other causes is shared equally. Modifications to a common wall require written consent from the adjoining owner. Walls on lot boundaries facing common area are maintained by the owner except the side facing common area is maintained by the association.
