The association maintains common elements and enforces rules; unit owners are responsible for their unit interior, demising walls, HVAC, and windows. Use is limited to private commercial office (including medical office); residential use is prohibited.
- Permitted use & restrictions: Units may only be used for private commercial office (including medical office). Residential, transient lodging, and timeshare uses are specifically prohibited.
- What you own & maintain: You own the interior air space of your unit, including finished surfaces and non-structural partitions. You must maintain your unit interior, demising walls, HVAC equipment (whether on roof or ground), windows/glass, and any exclusive patio or balcony. The association maintains common elements (e.g., building exterior, parking areas, landscaping) and designated limited common elements like parking spaces.
- Demising walls & party walls: Demising walls between units are party walls. You maintain your side; costs for routine maintenance or casualty repairs are shared equally with adjoining owners. Repairs caused by your negligence are your sole cost. The association may step in to repair and charge as a special assessment.
- Assessments & fees: Annual assessments fund common element operation, insurance, maintenance, and license fees (e.g., SRP license area). Annual increases cannot exceed the greater of 12% or CPI increase without owner vote. Special assessments for capital improvements or unexpected expenses require 50% of votes cast. Late payments incur a 10% one-time charge and 24% annual interest. Unpaid assessments become a lien on your unit.
- Parking & vehicles: Parking spaces may be designated as limited common elements for exclusive use by a unit owner. Reconfiguration or new designations require owner approval after declarant control ends. The association maintains all parking areas; costs for limited common element spaces are allocated proportionately to the benefiting owners.
- Architectural review: An architectural committee (or the board) must approve any exterior alterations or improvements to units or common elements. The committee may adopt rules and guidelines. Approval does not waive future compliance.
- Insurance & risk: The association carries master insurance for common elements. Unit owners are responsible for insuring their own unit's contents and improvements. If an owner's act causes damage to common elements, the repair cost (including insurance deductible) is charged to that owner as a special assessment.
