Vistara is a single-family-home HOA subdivision in Scottsdale/Mesa, Arizona — 119 lots governed by a declaration of covenants, conditions, and restrictions. This rulebook applies to all lot owners and their tenants, creating a homeowners' association with architectural oversight, use restrictions, and mandatory assessments.
- Single-family residential use: Lots must be used exclusively for single-family residential purposes. No business, trade, church, group home, or nonresidential use is allowed.
- Architectural review: All exterior changes — including buildings, fences, walls, landscaping, outdoor lighting, solar panels, antennas, and signs — require prior written approval from the Architectural Control Committee. Initial plan review fee is $300. The committee can also grant variances for hardship.
- Minimum house size & construction timeline: Each house must have at least 2,100 square feet of ground-level floor area (exclusive of garage, porches, guesthouse). Construction must be completed within 9 months of groundbreaking unless extended by the committee.
- Leasing & rentals: A lot may be rented to a single family, but for no less than one month. The owner remains responsible for any rule violations by tenants.
- Assessments & fees: The homeowners' association levies annual assessments (starting at $100 per lot, can increase up to 15% per year without a vote, or more with 2/3 member vote) and special assessments for capital improvements (requires 2/3 vote). Delinquent assessments accrue 18% interest and become a lien on the property.
- Parking & vehicles: Motor homes, boats, RVs, trailers, campers, and inoperable vehicles must not be visible from neighboring property. Garage doors must be kept closed except when entering or exiting. Only operating automobiles may be parked in uncovered areas.
- Fences, walls, and hedges: All fences, walls, and hedges must be within the building envelope. Maximum height: 3 feet in front yard, 6 feet in side/rear yards (10 feet for tennis courts with 20-foot setback). Corral fencing (open style) allowed only on specified lots in rear yards.
- Equestrian uses (specific lots only): Lots 75–90 and 114–119 may have corrals and stables in the rear third of the lot, no closer than 75 feet to any adjacent home, guesthouse, or swimming pool. Motor vehicles are prohibited in the natural arroyo designated for pedestrian and equestrian use.
