What Arroyo Heights's governing documents say
This is a Declaration of Restrictions for Arroyo Heights, a single-family home subdivision in Paradise Valley, AZ. The rules apply to all lot owners and limit use to residential purposes, with strict requirements for home size and architectural approval. This document does not create a traditional HOA with dues or common areas, but it does include an architectural control committee.
- Permitted use & structures: Each lot is for one private single-family dwelling plus a private garage for up to 3 cars. A guest house and/or servants' quarters are allowed, but only for actual non-paying guests or servants of the main residence. No main dwelling can be built until the main building is completed.
- Minimum home size: The principal dwelling must have at least 2,000 square feet of fully enclosed living space, excluding porches, terraces, garage, guest house, and servants' quarters.
- Architectural review: All new construction, additions, changes, or alterations (including fences, walls, etc.) require prior approval of plans and specifications by the Architectural Control Committee. The Committee may refuse approval for aesthetic or other suitability reasons.
- No livestock or poultry: No livestock or poultry of any kind (including horses, cows, pigs, chickens, etc.) may be kept on any lot.
- Duration and enforcement: The restrictions run with the land until January 1, 2000, and automatically renew for 25-year periods unless a majority of lot owners agree to change them. Violations may be enforced by legal action or damages; however, violations do not affect existing mortgage liens.
