Canadian Sunset is a condominium community in Paradise Valley, AZ. This document is an amendment to the original Declaration of Horizontal Property Regime and Covenants, Conditions and Restrictions. It changes who owns certain small parcels of land (like patios or yards) — before, they were common area shared by all; now, each parcel is owned in fee simple along with the adjacent unit.
- What you own & maintain: Each unit owner now owns the interior of their unit plus a specific contiguous parcel of land (labeled Parcel 1‑A, 2‑A, etc.) in fee simple. Those parcels are no longer common area. You are responsible for what's on that parcel (landscaping, etc.), but the association still holds an easement for utilities and service lines over those parcels.
- What is common area: The common elements now exclude the newly privatized parcels but still include all structures except the units, the land under buildings, recreational facilities, lawns, pavement, trees, and other landscaping (except landscaping inside interior patios or units).
- What this document doesn't cover: This amendment does not address leasing, pets, assessments, age restrictions, or many other typical HOA rules. For those, you would need the original Declaration recorded in Docket 12744, Page 807, and any other amendments.
