What Cholla Gardens's governing documents say
Cholla Gardens Unit Two is a single-family home subdivision in Paradise Valley, AZ, governed by recorded covenants that run with the land. These restrictions apply to all lot owners and their successors, dictating what can be built and how property may be used.
- What you own & maintain: Each lot is for one single-family dwelling only. Minimum ground floor area is 2,500 square feet (exclusive of open porches, garage, or carport). A private garage for up to 3 cars, a guest house, and servants' quarters are allowed, but no cooking facilities in guest house or servants' quarters. All secondary buildings must be attached to the main dwelling under the same roof line.
- Architectural review: No structure, fence, wall, or other improvement may be commenced without prior written approval of a three-person Committee (initially David J. Hannon, Carl F. Seitz, Clyde W. Wilson). Plans must include floor plans, elevations, specifications, plot plan, grading, and septic system. The Committee may deny for aesthetic or other reasons, and its decisions are final. After 80% of lots are sold, Committee members are elected by lot owners.
- Use restrictions: Lots are for residential purposes only. No commercial, religious, or institutional uses (church, store, office, hospital, hotel, etc.) are permitted. No subdivision of lots into smaller parcels. No temporary buildings, trailers, tents, or unsightly structures, except contractor's temporary structures during construction.
- Setbacks & siting: Building walls must be at least 40 feet from front or back lot line and 30 feet from side lot lines, unless topography requires a variation approved by the Committee. Homes may be placed in any direction to take advantage of views, provided setback requirements are met.
- Pets & animals: No livestock or poultry (horses, cows, mules, sheep, goats, chickens, turkeys, pigeons) are permitted. A maximum of two household pets per family is allowed, except puppies until weaned. Consistently noisy pets must be removed.
- Leasing & rentals: The entire dwelling unit and guest house may be rented or leased to a single family, but no guest house or portion of a dwelling unit may be rented separately. Leases are not subject to a minimum term restriction in this document.
- Parking & vehicles: Campers, trailers, boats, coaches, and excess household vehicles must be parked in the garage or hidden from view completely.
- Other restrictions: No clotheslines, equipment, service yards, woodpiles, or storage piles visible from roads or dwellings. No elevated tanks; fuel tanks must be buried or screened. No chain link boundary fences. No roof-mounted air conditioning units or coolers. No white, light-colored, or highly reflective roofing that could cause glare. No billboards except a single 16"x24" 'for sale or rent' sign. No radio towers except electrically/automatically raised types, lowered when not in use, with Committee approval. All antennas must be hidden or camouflaged. No foil or light-reflective material in windows. No temporary or permanent equipment visible from streets or other homes. Rubbish must be removed; no open burning or incinerators; trash receptacles must be screened.
