What The Highlands at Troon North Homeowners' Association's governing documents say
The Highlands at Troon North is a single-family residential subdivision in Scottsdale, Arizona, governed by its own homeowners' association within the larger Troon North master-planned community. You own your individual lot and dwelling; the association maintains common areas (streets, landscaping, recreational facilities) funded by per-lot assessments, and the community is subject to both this declaration and the parent Troon North Association's rules.
- What you own & maintain: You own your individual lot and single-family dwelling; the association maintains common areas including streets, landscaping, recreational facilities, gates, and utility infrastructure.
- Assessments & fees: Regular per-lot assessments fund common expenses (utilities, trash, landscaping, security, maintenance, liability insurance). Before the developer transitions control to homeowners (by the 'Turnover Date'), assessments are capped at $200 per year and require majority vote to exceed; after turnover, the board may adjust them. Payments more than 30 days late incur a $30 late charge plus 18% annual interest.
- Membership & voting: Every lot owner is automatically a member with one vote per lot. Voting rights are suspended if you fall 15+ days behind on assessments. Developer-controlled board will transition to member election by the Turnover Date (the earliest of 3 years from 1994, two-thirds of lots being sold, or whenever the developer chooses).
- Architectural review: No building, fence, wall, or other improvement may be added to your lot without prior written approval from the Troon North Association's Architectural Review Committee.
- Special assessments: The association can levy additional assessments to cover repair costs caused by an owner's negligent or willful acts, services benefiting individual lots, or construction of new common facilities (the latter requiring 66% member approval after developer turnover).
- Assessment liens & enforcement: Unpaid assessments create a lien on your lot with high legal priority, superseding all other liens except first mortgages and property tax liens. The lien survives sale of the property, and the association can foreclose; enforcement costs and attorney fees become your responsibility and add to the lien amount.
- Subject to parent association: The Highlands is a sub-association of the parent Troon North Association; its rules are subordinate to Troon North's Declaration, bylaws, and architectural policies. Owners must comply with both sets of restrictions.
