What Estate Antigua's governing documents say
Estate Antigua is a planned area development (single-family HOA) in Phoenix, AZ. This document is only a partial amendment to the community's full CC&Rs, adding two specific rules: one about scenic view maintenance, and one about a transfer fee. The complete CC&Rs are not included here, so this is not a full rulebook.
- Scenic views & landscaping: Lot owners must maintain landscaping so it does not diminish another lot's valley scenic views. If a lot owner materially impairs views, the Board may, after 30 days' written notice and a hearing if requested, perform repairs at the owner's expense. The cost becomes a lien and may be collected as an assessment.
- Transfer fee upon sale (Capital Contribution Fee): A Capital Contribution Fee of 0.5% of the gross purchase price or transfer value (whichever applies) is due upon sale or transfer of a lot. Exemptions apply for inheritances, estate planning transfers, or transfers to a majority-owned entity unless done to avoid the fee. Owners before this amendment was recorded are exempt for their current lots. The fee is non-refundable, deposited separately, and used for capital expenditures.
