This is a supplemental declaration for Dragoon Mountain Ranches Unit 2, a single-family residential community in rural Cochise County, AZ, that also permits non-commercial farm and ranch uses. It adds restrictions to a Master Declaration and applies to parcels 1–71. Owners automatically become members of the Dragoon Mountain Ranch Unit 2 Property Owners Association, which maintains internal roads and enforces architectural controls. The property is intended for attractive residential and non-commercial agricultural use.
- Land use & lot division: Each parcel may contain only one single-family residence, plus a private garage and a guest house (if approved). Guest houses may include a kitchen but cannot be rented separately. Lot subdivision is prohibited; contiguous parcels may be combined under single ownership and then cannot be re-divided.
- Construction & architectural review: All improvements require prior written approval from the Architectural Control Committee. Residences must be between 1,800 and 8,000 square feet (excluding garage, porches, overhangs), completed within 9 months of permit issuance, and set back at least 200 feet from property lines (unless waived). No mobile or manufactured homes are allowed. White or unanodized metal roofs are prohibited.
- Livestock & agriculture: Livestock, poultry, and domestic animals are permitted for personal use only, provided they do not create a nuisance. Pigs, fighting chickens, and wild animals are prohibited. Fencing must contain all livestock and is subject to architectural approval. Commercial agriculture is prohibited; crops for personal use are allowed.
- Assessments & fees: The Association sets annual assessments to cover road maintenance, insurance, and reserves. The initial assessment was $120 per parcel per year. Special assessments require a two-thirds vote of owners. Unpaid assessments become a lien on the parcel; holders of first mortgages are not liable for assessments that came due before they acquired title.
- Vehicles & parking: Only licensed vehicles may use roadways; all-terrain vehicles and unlicensed vehicles are banned. Boats, campers, trailers, and recreational vehicles must be stored at least 200 feet from parcel boundaries and not on roads or conservation easements. Vehicle repairs outside an enclosed garage are prohibited.
- Home business: A business may be conducted within a dwelling as long as it is not detectable from the exterior by sight, sound, or smell and is consistent with the residential character of the community. Excessive traffic or parking is not allowed.
- Temporary structures: No structure of a temporary character, motor home, or travel trailer may be used as a residence, except that a travel trailer or RV may be used during actual construction of the residence for up to 9 months, with prior architectural approval.
- Amendments & term: The declaration runs with the land for 25 years from recording (1998), automatically renewing for successive 10-year periods. Amendments within the first 15 years require approval of 50% of owners plus Declarant; thereafter, two-thirds of owners are needed. Termination requires a two-thirds vote six months before expiration of a term.
