Marbeya Condominiums is a condominium community in Paradise Valley, AZ — you own your individual unit (including built-in appliances) and an undivided 1/63rd interest in the general common elements, plus exclusive use of certain patios, balconies, entryways, and stairways shown on the plat. The association maintains the building exteriors, common areas, and landscaping, funded by annual assessments. Units may include garages that are subservient to dwelling units.
- What you own & maintain: You own your unit's interior (walls, floors, ceilings) and all interior finishes, doors, windows, HVAC, electrical/plumbing fixtures, and appliances serving only your unit. You must maintain, repair, and replace these at your own expense. The association maintains all general common elements, including building exteriors, roofs, bearing walls, foundations, utilities (except outlets within units), landscaping, roads, and parking areas.
- Single-family residential use: All units and restricted common elements must be used exclusively for residential purposes by a single family (defined as persons related by blood, marriage, adoption, or a group maintaining a common household). No business, profession, trade, or other nonresidential use is allowed on the property.
- Pets: A reasonable number of house pets is allowed, but no commercial breeding or nuisance. Dogs must be leashed (max 6 feet) outdoors and must not relieve themselves on common elements; owners must immediately remove droppings. No pet structures visible from outside. The board has discretion to determine reasonable numbers and restrict pets to certain areas.
- Parking & vehicles: Covered parking spaces are assigned by the board to each unit; open parking is available for owners, family, guests, and tenants. No mobile homes, trailers, trucks, campers, boats, or similar vehicles may be parked or stored on the property. No inoperable vehicles allowed. Street parking (public or private) is prohibited. Vehicle repairs visible from outside are not allowed except emergencies.
- Architectural review: Any structural alteration, addition, or improvement to a unit or common elements requires prior written approval from owners casting at least 51% of votes (for structural changes) and from the Architectural Committee (for nonstructural changes visible from outside). Exterior antennas, signs (except a 9x30 inch name/address sign), window coverings, and clothes drying facilities are all restricted and require committee approval.
- Leasing & rentals: Owners may lease their units. Lessees have the right to use general and restricted common elements during the lease term; the owner gives up use during that time. Guests must be accompanied by the owner or lessee. No time-sharing (occupancy in separated periods over 5+ years) is permitted.
- Assessments: Annual assessments are levied per unit to cover common expenses and reserves. Special and supplemental assessments may also be imposed. Assessments become a lien on the unit if unpaid. Voting rights are suspended if assessments are unpaid for 15 days or more.
