You own your unit's interior and share ownership of common elements—pool, spa, clubhouse, parking areas, walkways, landscaping—which the association maintains and insures, funded by equal per-unit assessments. This 1997 Declaration binds all unit owners to its rules and governance.
- What you own & maintain: You own your unit's interior finishes, plus a designated patio (first floor) or balcony (second floor) and storage area. The association owns and maintains the building structure, common elements, and carries master insurance on shared property—you are responsible only for damage you cause.
- Pets: Maximum 2 dogs per unit; individual pets cannot exceed 40 pounds unless they are service animals. All pets must be leashed (maximum 6 feet) when outside your unit, and you are responsible for immediately removing any pet waste from common areas—pets are not permitted to use common elements as bathroom areas.
- Parking & vehicles: Each unit receives one assigned covered parking space; the board can reassign spaces for handicapped accessibility or to equalize walking distances. Only passenger vehicles, pickup trucks under 3/4 ton, SUVs, minivans, and motorcycles are permitted—RVs, trailers, boats, campers, and commercial vehicles are strictly prohibited. No storage in parking areas.
- Residential use & home business: Units are for residential use only. A home business is allowed if it is completely invisible and inaudible from outside, involves no customer visits, has at most one non-resident employee, generates no excessive traffic, and doesn't violate zoning or create nuisance conditions.
- Improvements & alterations: Non-structural interior changes don't require approval, but you're liable for any damage you cause. Structural changes inside or any work visible from outside requires prior board approval plus certification from a licensed Arizona architect or engineer that the work won't compromise the building's integrity.
- Assessments & payment obligations: Common expenses are assessed equally per unit (each unit pays 1/84 of total costs). The association places a lien on your unit for unpaid assessments, and failure to pay for more than 30 days results in suspension of your voting rights.
- Architectural review & design standards: Any exterior work, additions, or visible alterations require board approval. The board grants approval only if it finds the work aesthetically pleasing and in harmony with existing improvements—subjective design authority rests with the board.
