Paradise View Villas is a condominium community in Paradise Valley, AZ — you own your individual unit and share ownership of the building's common elements with other unit owners. The association maintains the common areas and carries master insurance, funded by assessments on each unit. This declaration outlines the rights and restrictions that apply to all owners and residents.
- What you own & maintain: You own the interior of your unit (including finished surfaces, interior fixtures serving only your unit) and any limited common elements allocated to your unit (such as a patio or parking space). The association maintains all common elements (hallways, roofs, landscaping, etc.) and carries master property and liability insurance. You are responsible for repairing damage caused by your negligence.
- Leasing & rentals: You may only rent your entire unit (not individual rooms). A specific group of units (not identified in the declaration) has a minimum lease term of seven (7) days; all other units may be rented for any term, including nightly. You are responsible for any rule violations by your tenants or their guests.
- Pets: Up to two (2) commonly accepted household pets are allowed per unit without prior board approval. Additional pets require board approval. Vehicles must be parked only in designated parking spaces (including your assigned limited common element parking). The board may tow violating vehicles at the owner's expense.
- Use restrictions: Units may be used only for single-family residential purposes. No commercial, professional, or business activity is allowed (except incidental home office work). No outdoor antennas, satellite dishes, or signs (including for-sale/for-rent signs) may be visible from outside without board approval. Nuisances, excessive noise, and unlawful activities are prohibited.
- Architectural changes: Nonstructural interior changes (e.g., painting, flooring) do not require approval. Structural changes, exterior alterations (anything visible from outside), or changes to common elements require prior written board approval, and for structural work, a licensed architect or engineer must certify it won't impair structural integrity.
- Fees & assessments: Owners pay monthly common expense assessments (equal per unit). A special assessment of over 2/3 of unit owners' vote may be levied for capital improvements. Late payments incur interest and late fees, and the association can place a lien on your unit. A transfer fee and a working capital fund payment (equal to two months' assessment) are due upon purchase.
