Tatum Garden Estates is a single-family residential subdivision in Paradise Valley, AZ. These restrictive covenants run with the land and apply to all lot owners. The rules are designed to maintain a park-like, upscale residential character.
- Construction & design: All new buildings and alterations must be approved in writing by the developer (or successor). Minimum ground-floor area for a dwelling is 2,000 square feet (excluding garage, porches). Maximum building height is 24 feet from the highest natural grade. Detached structures may only be built on the rear half of the lot.
- Utilities & fencing: Electric, telephone, and cable lines must be installed underground. Chain link or metal fencing of any type is not permitted.
- Outdoor storage: Boats, trailers, campers, and similar items must be stored in the rear half of the lot or enclosed by a wall at least 6 feet high. Clotheslines, garbage cans, service yards, woodpiles, and storage piles must be screened from view.
- Pets & animals: No livestock (horses, cows, sheep, goats) are allowed. Household pets are permitted, but not for commercial purposes.
- Use restrictions: All lots are for residential use only. No business may be conducted in or from any residence. Advertising signs are limited to 'For Sale' and 'For Rent' signs only. No nuisances or activities that endanger health or unreasonably disturb neighbors.
- Enforcement & amendments: These restrictions run with the land and may be enforced by any lot owner through court action. Failure to enforce does not waive future enforcement. After January 1, 1975, amendments require a majority vote of lot owners.
