Windsor East is a 9-unit condominium community in Paradise Valley, AZ — you own your individual apartment unit (including a garage and patio) plus a shared interest in common elements maintained by the Windsor East Homeowners' Association. This declaration establishes the condominium regime, owner obligations, and association powers.
- What you own & maintain: You own the airspace within your apartment's unfinished floor to ceiling, interior surfaces, and any included appliances. You also own a designated garage and patio. You maintain interior decorating and nonstructural changes; the association maintains common elements (buildings, pool, landscaping, etc.) and carries master insurance.
- Assessments & fees: Each unit pays a regular assessment, initially capped at $720/year (until April 1984). After that, the board can increase it annually up to the greater of CPI or 5% without a vote; larger increases need 2/3 approval of each membership class. Special assessments also require 2/3 vote. Assessments are due monthly and become a lien if unpaid, with 12% interest and foreclosure rights.
- Voting & membership: Each unit owner gets one vote (Class A). The original developer had three votes per unit (Class B) until the earlier of when Class A votes equal Class B or May 31, 1984, after which Class B converts to Class A. Owners in arrears or in default lose voting rights after 15 days' notice.
- Alterations & improvements: Nonstructural interior changes do not require board approval, but you are liable for any damage. Structural changes need prior board approval plus an engineer/architect certification that structural integrity is maintained. Any alteration visible from outside must be pre-approved for aesthetic harmony.
- Party walls: Walls and roofs shared between units are party walls. If you or your guests damage a party wall, you must repair it at your cost. If damage is from other causes, the association repairs it. Proposed changes to party walls need board consent.
- Common element use: Owners and their residents, tenants, and guests may use common elements subject to association rules. The association can limit guests, charge fees for recreational facilities, suspend use for unpaid assessments, and borrow money for common improvements with proper approval.
