El Segundo East is a condominium community in Paradise Valley, AZ. This document is an amendment to the community's Covenants, Conditions and Restrictions (CC&Rs) and does not contain the full rules. It updates rules about assessments and the lien priority of mortgages.
- Assessments & budget: The Board sets annual assessments based on a budget that must include reserves. The maximum annual assessment increase is tied to the Consumer Price Index for All Urban Consumers (CPI-U). Special assessments for capital improvements or other lawful purposes require a two-thirds vote of owners. Supplemental assessments for budget shortfalls also require a two-thirds vote.
- Late fees & interest: Assessments paid within 15 days of the due date bear no interest. After 15 days, unpaid amounts accrue interest at 12% per annum or the prevailing FHA/VA new home loan rate, whichever is higher. Payments are applied first to interest, then to the earliest due assessment.
- Lien priority: The association's assessment lien is subordinate to any first mortgage lien. A sale or transfer of a unit does not affect the assessment lien, but a foreclosure extinguishes liens for assessments that became due before the sale. Future assessments remain due.
- What this document doesn't cover: This amendment does not address leasing, pets, parking, age restrictions, architectural review, or other common rules. For those, refer to the full CC&Rs.
