Tierra Norte III is a single-family home subdivision in Peoria, AZ. These covenants run with the land and bind all owners. The document establishes an Architectural Review Committee (ARC) that must approve exterior changes, and includes rules on parking, pets, signs, and maintenance.
- Use restrictions: All lots must be used for single-family residential purposes only. No gainful occupation, profession, or trade is allowed. Leasing to a single family is permitted, subject to all provisions.
- Architectural review: Any exterior improvement, alteration, or new construction (including fences, HVAC, solar panels) requires prior written approval from the Architectural Review Committee (ARC). Submit plans; ARC has 30 days to respond or it is deemed approved. The ARC may charge a processing fee.
- Parking & vehicles: No vehicles exceeding 3/4 ton, mobile homes, trailers, boats, or campers may be parked visibly from neighboring property. Pickup trucks under 3/4 ton and mini-motor homes under 7 ft height and 18 ft length are allowed if used for basic transportation. Inoperable vehicles must not be visible. Garages must be used for parking and kept closed when possible.
- Pets: Only a reasonable number of generally recognized house or yard pets are allowed, kept as domestic pets (not commercial). They must not create unreasonable noise or nuisance. Structures for pets must not be visible from neighboring property.
- Fences & walls: All fences must be of block construction (unless ARC approves otherwise) and painted to match the structure. Maximum height 6.5 feet, but within 15 feet of front property line, max 3 feet. Party walls and fences are jointly maintained and subject to specific rules.
- Signs: Only one name/address sign not exceeding 9" x 30" is permitted. One temporary sign of up to 5 square feet may be placed for sale or rent. Declarant may erect signs during construction and marketing.
- Landscaping & maintenance: Lots must be landscaped within 180 days of purchase, kept free of weeds and debris, and lawns mowed and trimmed. Dead plants must be replaced. No condition that breeds insects or plant diseases.
