3rd Ave. Commercial Village is a commercial retail center in Phoenix, AZ, governed by a Declaration of Covenants, Conditions, and Restrictions that binds the owners of four commercial lots (car wash, restaurant/retail, etc.). This document sets rules for the use, maintenance, and appearance of the property, and establishes an owners association to manage shared features like the internal roadway, common landscaping, and signage. It applies to commercial property owners and their tenants, not to residents.
- Use restrictions: Lots may be used for any legal use consistent with zoning, but specific uses are banned: massage parlors, adult bookstores, top-less or nude bars, and similar adult-oriented businesses. No livestock or animals (except caged birds/fish indoors), no open burning, no antennas visible from neighboring lots, and no mineral exploration.
- Architectural review: All new construction and exterior modifications require prior written approval from the Declarant (while it owns any lot) or the Board of Directors. Approval covers site plans, floor plans, elevations, colors, materials, and landscaping. The review body has 30 days to object; silence means approval. Exterior repainting must use colors harmonious with existing improvements.
- Maintenance & assessments: The Association levies annual and special assessments (based on square footage of each lot) to maintain the internal roadway, common landscaping, common signs, and common retention area. Owners maintain their own lots, including lot landscaping, street buffer walls, and lot roadways. Assessments become a lien on the property if unpaid.
- Signs: A comprehensive sign plan governs all signage. Common signs (for facilities on multiple lots) are maintained by the Association; other signs are the responsibility of the lot owner. Signs must comply with the approved plan and City requirements.
- Parking & vehicles: Each lot must maintain the required number of parking spaces per zoning. No on-street parking on Bell Road, 3rd Avenue, or the internal roadway. No vehicle may be stored or abandoned, and vehicles cannot be used as signs.
- Project Facilities & easements: The internal roadway, common landscaping, common retention area, and common signs are shared facilities. The Association maintains them. Perpetual easements exist for roadway access, utilities, drainage, and temporary construction. Cross-parking easements require separate agreements.
