It establishes an HOA (North Central Estates West Owners Association) and applies to all lot owners, residents, and their guests. The rules cover permitted uses, maintenance obligations, assessments, architectural controls, and restrictions on vehicles, pets, signs, and nuisances.
- Residential use & occupancy: Each lot must be used as a residence occupied by a single family (defined as persons related by blood, marriage, or adoption, or up to an unrelated group maintaining a common household). No commercial, professional, or gainful activity is allowed on any lot.
- Pets: Only a reasonable number of generally recognized house or yard pets are allowed, kept as domestic pets only. Pets must be leashed (max 6 ft) when off the owner's lot, and owners must immediately remove droppings. No structure for pets may be visible from neighboring property.
- Assessments & fees: The Board sets annual assessments in its sole discretion; special assessments require a 2/3 vote of members. Assessments are a lien on the lot and the owner's personal obligation. Nonpayment accrues interest and may lead to foreclosure. A working capital fund equal to 1/6 of the annual assessment is due from each initial purchaser.
- Architectural review: Any exterior addition, alteration, or change (including landscaping, paint, window coverings, HVAC, solar panels) requires prior written approval from the Architectural Committee. Application must include plans; if no decision within 60 days of complete submission, approval is deemed granted. The Committee may charge a review fee.
- Parking & vehicles: No trucks (over 3/4 ton), trailers, campers, boats, or recreational vehicles may be parked visibly from neighboring property or streets, except pickup trucks under 3/4 ton with camper shells ≤7 ft tall, or mini-motor homes ≤7 ft tall and 18 ft long used for basic transportation. Inoperable vehicles and vehicle repair are prohibited. The Association may tow violating vehicles at owner's expense.
- Signs: No signs are allowed except one residential identification sign (≤72 sq in), one 'for sale' or 'for rent' sign (≤5 sq ft), and signs required by legal proceedings. Political and commercial signs are not permitted.
- Nuisances & maintenance: No nuisance may exist on a lot. Owners must keep their lots, buildings, and landscaping in good repair. Trash must be in covered containers and kept out of view except during collection. Outside clotheslines are allowed only if not visible from neighboring property. Outdoor burning is prohibited except for barbecues.
