What Anasazi Village Condominiums's governing documents say
Anasazi Village Condominiums is a condominium community in Phoenix, AZ. This document is a board-adopted resolution regulating satellite dishes and TV antennas, not the full condo rulebook. It applies to unit owners, tenants, and occupants, but owners are ultimately responsible for compliance.
- Antenna types allowed: Only three types are covered: Direct Broadcast Satellite (DBS) antennas 1 meter or smaller, Multi-point Distribution Service (MDS) antennas under 1 meter, and TV broadcast antennas. All other antennas remain subject to the Declaration's prior written authorization requirement.
- Antenna placement restrictions: Antennas must be installed entirely within the unit or on your balcony/patio (a limited common element). They cannot be placed on balcony ledges, rails, side walls, or anywhere that encroaches on common elements or another owner's property. Penetrations of the building's exterior (except balcony/patio walls in limited cases) are generally prohibited.
- Shielding and appearance: Antennas must be shielded from view from the property and neighboring units to the maximum extent possible, as long as acceptable signal quality is maintained. The Association may require reasonably priced plants or screening. Antennas, masts, and visible wiring must be painted to match the structure unless that interferes with signal or voids the warranty.
- Installation safety and standards: Installation must follow manufacturer instructions, comply with all applicable laws and codes, and not damage common elements or building integrity. Antennas must be properly grounded, secured, and not placed near power lines. Masts must be no higher than necessary and not encroach. Any penetrations (if allowed) must be waterproofed per industry standards.
- Owner responsibility and maintenance: The unit owner bears all costs of installation, maintenance, and removal. The owner is liable for any damage caused by the antenna and must indemnify the Association. At removal, the installation site must be restored to original condition. If the Association needs to do maintenance requiring antenna removal, owners get 10 days' notice and must remove/replace at their own expense.
- Notification and enforcement: Owners must submit a completed notification form to the Association within 5 business days after installing an allowed antenna. Violations can result in a $50 fine plus $10 per day if not corrected, and the Association may seek court or FCC enforcement. The Association can also recover attorney's fees.
- What this document doesn't cover: This is only an antenna resolution. It does not cover other community rules such as pet limits, leasing restrictions (except that leases are subject to the Declaration's 6-month minimum), assessments, parking, age restrictions, architectural review beyond antennas, or other typical HOA/condo regulations.
