Apache Peak Ranch is a single-family residential subdivision in Phoenix, AZ, governed by a homeowners association (HOA). All lot owners are automatically members of the Apache Peak Ranch Community Association and must pay assessments for common expenses. The rules bind owners, residents, and guests.
- What you own & maintain: You own your lot and the home on it. You are responsible for all maintenance, landscaping, repairs, and replacements within your own lot, including septic systems. The Association maintains common areas and common expenses.
- Assessments & fees: Regular assessments are paid monthly. There are also special assessments (e.g., for fines or compliance), capital improvement assessments, and reconstruction assessments. Assessments are a lien on the lot and personal obligation of the owner.
- Leasing & rentals: An owner who leases their lot is responsible for ensuring the tenant complies with all rules. No minimum lease term is specified.
- Architectural review: Any exterior changes (building, fence, paint, landscaping, etc.) require prior written approval from the Community Design Review Committee. Guidelines are on file with the Association.
- Parking & vehicles: Boats, trailers, buses, motor homes, campers, and similar vehicles may only be parked or stored inside an enclosed garage. No vehicle repairs on lots or common areas. Overnight street parking is prohibited except for temporary construction vehicles. Golf carts, dirt bikes, and off-road vehicles are banned on common areas.
- Use restrictions: Lots are for residential use only – no businesses. No temporary buildings or trailers. Signs (including 'For Sale' or 'For Rent') are generally prohibited without approval. No clotheslines, no obstruction of drainage, no nuisances.
- Pets: Only a reasonable number of commonly accepted household pets are allowed – no horses, farm animals, fowl, or poisonous reptiles. Pets must not run free or create unreasonable annoyance.
- Enforcement: The Association can enforce rules through fines (as special assessments), liens, and other legal remedies. The Board has discretion to determine nuisances and non-compliance.
