Arroyo Springs is a single-family residential HOA in Phoenix, Arizona. Lot owners are bound by this comprehensive CC&R document governing assessments, architectural review, landscaping, vehicles, pets, and property use.
- What you own & maintain: You own your individual lot with a single-family residence and private garage. The association maintains common areas and can enter your property with 30 days notice to maintain or repair the exterior or drainage if you fail to do so.
- Assessments & HOA fees: Annual assessments are levied per lot, starting at $14.95 per month through 1995, then increasing each January 1 by the greater of 10% or the Consumer Price Index. Unpaid assessments incur a late charge of $10 minimum or 12% annual interest and create a foreclosable lien on your property; special assessments for capital improvements require a two-thirds member vote.
- Architectural review & approval: Any exterior alterations—including landscaping, painting, color changes, fences, walls, and building modifications—require prior written approval from the Architectural Committee. The committee has 30 days to approve or deny; if no decision is made within 30 days, approval is automatically granted.
- Vehicles, trailers & parking: Motor vehicles exceeding 3/4 ton, mobile homes, RVs, boats, trailers, and campers cannot be parked or stored visible from neighboring properties or common areas; exceptions include pickup trucks under 3/4 ton with camper shells 7 feet tall or less, and mini-motorhomes 7 feet tall and 18 feet long or less. Garages must be used for parking and storage only, not converted to living space without approval.
- Landscaping & exterior maintenance: Front yard landscaping must be installed within 90 days of closing. The association maintains all common area landscaping and can enter your property to maintain it; trees and shrubs cannot overhang into common areas above 12 feet without approval. The association can order exterior repairs or painting, and if not completed within 30 days, will perform the work at your expense.
- Pets & animals: Only a reasonable number of generally recognized house or yard pets are permitted, kept solely for domestic purposes. The board has sole discretion to determine whether a specific animal is acceptable, and can prohibit it if it makes unreasonable noise or becomes a nuisance.
- Use restrictions & business activities: The property must be used exclusively for single-family residential purposes; no business, trade, profession, or gainful occupation is permitted. Only small name and address signs (9 inches by 30 inches) and temporary sale or rent signs (5 square feet maximum) are allowed; antennas and visible utility lines require approval.
- Party walls & shared fences: Walls and fences between adjacent lots are shared between owners with equal rights. If a wall or fence is damaged through your actions or those of your family/guests, you must rebuild it at your own expense; if damaged otherwise (wear and tear, acts of nature), all adjoining owners share the repair cost equally.
