What La Salle Heights's governing documents say
La Salle Heights is a small subdivision of four 1-acre single-family lots in Phoenix, AZ, created by a 1999 declaration that establishes a shared well system. This document creates easements and sets rules for the well's use, maintenance, and cost-sharing among the four property owners. It is not a full homeowners association — it only governs the shared well.
- Shared well costs & responsibilities: All four owners share equally in Well Maintenance Costs (repairs, replacement, insurance, taxes) and Normal Operating Costs (electricity, water quality testing) as active users. Prior consent of all active users is required for non-emergency work. Each owner maintains their own delivery line from the well.
- Water use restrictions: Water may only be used on the four parcels, for private domestic purposes (household, gardens, livestock, landscaping, swimming pools with impervious liners). No additional users beyond the four lots are allowed.
- Default & liens: If an owner fails to pay their share within 60 days of a written statement, the other owners may shut off water access and record a lien against the defaulting owner's parcel. The lien accrues 1% monthly interest and can be foreclosed similarly to statutory liens.
- Easements: The document grants a Well Site Easement on the servient parcel (38310 N 17th Way) and three Access Easements for the dominant parcels to reach the well and run water lines. Landscaping or improvements that impair these easements are prohibited. Sewage systems must be at least 100 feet from the well.
- Dispute resolution: Any dispute under the declaration must be submitted to binding arbitration (e.g., American Arbitration Association). The prevailing party is entitled to twice its reasonable attorney fees and costs.
- Amendments & duration: The declaration runs with the land in perpetuity. Amendments require unanimous written agreement of all four owners and must be recorded. No amendment is allowed during the term of any federally insured mortgage on any parcel.
- What this document doesn't cover: This document covers only the shared well and related easements. It does not contain rules about pets, leasing, architectural controls, parking, or any typical HOA regulations. Each lot is otherwise governed only by general county zoning and property law.
