What Arcadia Commons Condominium's governing documents say
Arcadia Commons Condominium is a commercial condominium in Phoenix, AZ — you own your individual unit and share ownership of common elements (like the building structure, common areas, and parking). The association maintains the common elements and perimeter walls, and carries master insurance. This is not a residential community; units may only be used for professional offices (e.g., medical, dental, law, real estate, etc.) and related uses approved by the association.
- Use & occupancy: Units must be used exclusively as offices for professional services (medical, dental, law, architecture, accounting, real estate, etc.). Other uses require either compliance with zoning or approval from the Declarant/Board (during Declarant control) or all unit owners (after).
- Pets: No animals, birds, reptiles, fowl, poultry, or livestock are allowed in any unit or on the property, except fish in aquariums and animals/birds/reptiles kept by a veterinarian in connection with their practice.
- Leasing & rentals: Leases must be in writing and must state that they are subject to the declaration and rules. The owner must provide the association with the lease start/end dates, lessee names, owner contact info, and emergency contact at least 10 days before the lease begins. The owner is liable for any violations by the lessee or occupants.
- Parking & vehicles: Each unit is allocated designated covered parking spaces (per Exhibit C). Parking is allowed only in those spaces. No inoperable vehicles, and no trucks, trailers, campers, boats, or recreational vehicles may be parked or stored on the property. Vehicle repair (except emergency) is prohibited. The Board may tow violators at the owner's expense.
- Signs & exterior alterations: No signs (including 'For Sale' or 'For Rent') are allowed on the exterior or visible from outside without Board approval. The Board may permit identification signs subject to location, size, color, and style criteria. All exterior alterations, window coverings, antennas, and satellite dishes require prior Board approval.
- What you own & maintain: You own and must maintain the interior of your unit (excluding perimeter walls) and certain limited common elements (like pipes/ducts serving only your unit). The association maintains and repairs all common elements, the perimeter building walls, and the sprinkler/fire alarm systems.
- Assessments: The Board adopts an annual budget and assesses each unit a common expense assessment based on its percentage interest (as shown on Exhibit B, not provided). Special assessments and enforcement assessments may also be levied. The association may lien units for nonpayment.
