Marble Condominiums is a 36-unit condominium community in Scottsdale, AZ governed by a Declaration of Condominium (horizontal property regime). You own your individual unit and share a 1/36th undivided interest in the common elements (including parking, walks, landscaping and amenities), which the association maintains through assessments.
- What you own & maintain: You own the interior space of your unit (bounded by unfinished surfaces of ceiling, floor, and perimeter walls) plus any exclusive HVAC equipment. The association owns and maintains all common elements, including the buildings' structure, common hallways, parking areas, driveways, landscaping, and any added amenities (pool, laundry, storage, carports).
- Assessments & fees: Annual assessments begin the month after the first unit is sold. The initial maximum annual assessment was $590 per unit. Each year the board may increase assessments up to 5% without a member vote; increases above 5% require a 2/3 vote of each class of members. Special assessments for capital improvements also require a 2/3 vote. Assessments are due as set by the board; unpaid assessments accrue 6% annual interest and become a lien on the unit.
- Parking & vehicles: At least one parking space is assigned exclusively to each unit and numbered the same as the unit. All other spaces are for common use by owners and guests. The board can set additional rules for parking area use and management.
- Architectural review: No exterior structure, addition, or alteration may be built without written approval from the board or an architectural committee. Plans must be submitted for review of external design harmony. If the board does not approve or disapprove within 30 days, approval is deemed granted.
- Amendment & duration: The declaration runs for 20 years from recording (1983), then auto-renews every 10 years. Amendments during the first 20 years require 90% of unit owners' signatures; afterward, 75% is required. All amendments must be recorded.
