What Arcadia Gardens Condominiums's governing documents say
Arcadia Gardens Condominiums is a condominium community in Phoenix, AZ — you own your individual unit and an undivided interest in the common elements, which the Association maintains and insures through assessments. This Declaration of Condominium establishes the legal framework for ownership, use, and governance of the property.
- What you own & maintain: You own the interior finished surfaces of your unit, including plumbing and electrical that exclusively serve it, but not structural components or shared systems. You are responsible for all maintenance, repairs, and decorating inside your unit, and for keeping your patio or balcony neat. The Association maintains the common elements (e.g., buildings, walkways, parking areas).
- Leasing & rentals: Leases must be in writing, comply with the Declaration, Articles, and Bylaws, and include a provision that violation is a default. A copy must be delivered to the Association before the lease term begins. No lease may be for less than the entire unit. Transient or hotel use is prohibited.
- Pets: Commonly accepted household pets not exceeding 20 pounds may be kept, but no breeding allowed. Pets must not be left loose or unsupervised. Walking of pets is subject to rules and fines set by the Board.
- Use restrictions: Units must be used as single-family residences only (or two or more adjoining units combined). No transient or hotel purposes. No temporary structures, tents, shacks, barns, or trailers are allowed on the property.
- Architectural review: No alterations to common elements, patios, or balconies without prior written Board approval. Non-structural interior alterations do not require approval, but structural alterations need a majority vote of owners and approval of all first mortgagees. Plans for altering adjoining units must be submitted to the Board.
- Parking & vehicles: The Board may determine that any vehicle creating noise or unsightly storage is a nuisance and prohibit its operation or storage on the property.
