What Casitas Grande at South Mountain's governing documents say
Casitas Grande at South Mountain is a single-family home community in Phoenix, AZ, governed by a homeowners association (HOA). This Declaration of Covenants, Conditions and Restrictions applies to all owners of lots (homes) in the subdivision. It establishes rules for property use, architectural changes, assessment fees, and maintenance responsibilities.
- Occupancy & residential use: Each home must be used as a single-family residence. A 'Single Family' means one or more persons related by blood, marriage, or adoption, or a group of no more than three unrelated persons living together as a common household. No business or trade may be conducted on the property, except for home-based businesses that are not detectable from outside and comply with zoning.
- Leasing & rentals: Owners may not lease or sublease a lot without prior written consent of the Association. Leases for at least 30 consecutive days are not considered a business. The Association may enforce rules against tenants and has a power of attorney to do so.
- Architectural & exterior changes: Any exterior alteration, construction, or landscaping requires prior written approval from the Architectural Committee. Applications must include detailed plans; the committee has 45 days to respond, after which approval is deemed granted if no response. A processing fee may be charged.
- Assessments & fees: Annual assessments are levied per lot to cover common expenses. The board cannot increase annual assessments by more than 20% over the prior year without majority member approval. Special assessments require a 67% vote of members. Fines, late fees, and collection costs may be added.
- Maintenance responsibilities: The Association maintains common areas (landscaping, structures, etc.). Each owner is responsible for maintaining their lot and all improvements (house, yard, etc.) in good condition. If an owner fails to maintain, the Association may perform work and charge the owner as a lot-specific assessment.
- Rules & enforcement: The Association may adopt rules on topics like noise, vehicles, signs, and trash. Violations result in fines and potential suspension of voting rights or common area use. Fines require a notice and hearing process. Delinquent assessments can lead to a lien and foreclosure.
