What Oro Vista's governing documents say
Oro Vista is a single-family home community in Phoenix, Arizona, created by Habitat for Humanity. This Declaration of Covenants, Conditions, and Restrictions (CC&Rs) governs all property owners and residents. Key rules include mandatory owner-occupancy (no leasing allowed), architectural review for exterior changes, and disclosure of aircraft noise from nearby Sky Harbor International Airport.
- Owner-occupancy & leasing: Each owner must occupy their dwelling as their principal residence immediately upon purchase and for the entire duration of ownership. Leasing or renting the home is strictly prohibited for any reason.
- Architectural review: All exterior improvements, including structures, landscaping, and painting (unless repainting with previously approved colors), require approval from the Architectural Review Committee (ARC) or Declarant. Interior work does not need approval.
- Business use: No business may be conducted from a lot unless it is a home-based activity that is not detectable from outside (by sight, sound, or smell), complies with zoning, involves no regular client visits, and does not threaten security or the residential character.
- Occupancy & household definition: A dwelling unit may be occupied by persons related by blood, marriage, or adoption, or by a group of no more than three unrelated persons living together as a single household.
- Assessments & finances: The Association levies annual Base Assessments, Special Assessments (requiring 2/3 owner vote and Declarant approval if applicable), and Benefited Assessments for violations. Assessments are personal obligations and become a lien on the lot if unpaid. Reserve funding is required.
- Maintenance responsibilities: Owners must maintain their lot, dwelling, and adjacent sidewalks/landscaping to the Community-Wide Standard. The Association maintains common areas, including landscaping in public rights-of-way and storm drainage systems.
- Use restrictions & rule making: The Board may amend Use Restrictions with 5 business days' notice and an opportunity for member disapproval via petition. Members can also propose changes by majority vote with Declarant approval. Changes take effect 30 days after mailing to owners.
- Airport disclosure: All lots are subject to aircraft noise, vibrations, and dust from Sky Harbor International Airport. Owners release Declarant from any future claims related to airport operations.
