Fremont Cove is a planned community of single-family homes in Phoenix, AZ, governed by a homeowners association (HOA). All owners, residents, and tenants are bound by the covenants, conditions, and restrictions in this declaration, which covers architectural control, use of property, assessments, and maintenance.
- Architectural review: Exterior changes—including landscaping, paint, fences, and structures—require prior written approval from an Architectural Committee. Plans are reviewed for harmony with the neighborhood; the committee has broad discretion to deny even compliant proposals. Fees may apply.
- Residential use & home businesses: All lots must be used for residential purposes only. Home businesses are allowed if they are not detectable from outside, involve no customer visits, use no non-resident employees, and do not increase traffic or parking beyond normal residential levels.
- Pets: No more than two domestic pets (dogs, cats, or similar household birds) may be kept on a lot. Pets must be confined to the owner's lot; dogs must be leashed (max 6 feet) when off the lot. Owners must clean up feces on common areas. The board may ban pets that are a nuisance or threat.
- Parking & vehicles: Vehicles must be parked in the garage. If space is insufficient, they may park in the driveway if under 7' tall and 18' long. Commercial vehicles and recreational vehicles over those dimensions can only be parked for loading/unloading (max 24 consecutive hours, 72 hours per 7 days). No inoperable vehicles visible from neighboring property. Towing is permitted for violations.
- Leasing & rentals: Owners may lease their entire lot (not partial) with a written lease of at least one month. Subleasing and assignments are prohibited. Owner must provide the association with tenant info and lease copy at least 10 days before occupancy. Owner remains liable for tenant rule violations.
- Assessments & fees: Annual assessments are set by the board equally per lot. Special assessments require two-thirds member vote (plus declarant approval while declarant owns lots). Assessments are a personal obligation and a lien on the lot. Late fees and interest apply after 15 days. The association can foreclose on the lien.
- Maintenance responsibilities: The association maintains common areas (tracts, landscaping, entry gates). Lot owners are responsible for their own lots and improvements. The board sets a maintenance standard. The association may enter lots to inspect or correct violations.
